Acid Attack commonly known as Acid Throwing is an assault in which a Chemically corrosive acid is thrown into any of the Body parts of the other Individual to cause disfigurement or death intentionally. Acid Attack has been specifically criminalized in Nepal and considered to be a serious Crime.
The National Penal Code has incorporated the Acid Attack Law in Nepal. Chapter 14 on Offenses relating to Hurt or Grievous Hurt Section 193 has prohibited disfigurement by the use of Acid or other Chemical, Biological, or Toxin Substances.
Acid Attack Law in Nepal
Disfigurement, in one form or another, has been condemned and sanctioned by Nepalese Laws. The Act has provided that Acid, Chemical Substances, Biological Substances, or Toxin Substance can cause disfigurement.
Prohibition
The Law has prohibited causing Bodily Pain to another person through the means of Disfigurement
Method of Causing Pain
The Use and Administration of Acid or Similar Chemical, Biological, or Toxin Substances has been seriously prohibited as the method of causing pain under this law.
Act
The Provision has provided that such harm is induced by throwing the above methods of causing pain onto another person.
Physical Harm
The Consequence of the act is the usage of the Method of Causing Pain Burning, Maiming, or Scalding of the Body.
Disfigurement
After physical harm has been brought upon the body, the Individual is criminally liable if the Methods of Causing Pain disfigure the face or any part of the body of another Person.
In other words, One isn’t allowed to hurt someone else through the use of acid or other harmful Substances by throwing those substances which results in Burning or Injuring the Body or by disfiguring their face or their body.
Punishment for Acid Attack in Nepal
The Punishment for Acid Attack depends on the amount of damage caused and the organ targeted.
Disfigurement of Face
As provided by the National Penal Code, for causing the disfigurement of the face, the offender is liable to a sentence of Imprisonment for a term of five to eight years. Further, they are liable to a fine ranging from NPR 1,00,000 to NPR 5,00,000.
Disfigurement of Other Bodily Organs or Bodily Pain
The Act has stated that an individual is liable to a sentence of Imprisonment for a term of three to five years if any body organ or bodily pain is brought upon the Victim. They are to be fined ranging from NPR 50,000 to NPR 3,00,000 for disfigurement of Bodily Organs.
Compensation
Moreover, Sub-Section 3 OF Section 193 has guaranteed that the amount of Fine collected from the Offender must be completely paid to the Victim as compensation.
Statute of Limitation
The Statute of Limitation for filing the First Information Report of Acid Attack Cases in Nepal lies one year from the date of the commission of the Crime.
